Visiting this website

When you visit this website, your browser transmits technically necessary data to the server: your IP address, the date and time of access, the address requested, the amount of data transferred, the previously visited page, and your browser and operating system. This data is stored in server log files in order to deliver the website, ensure its security and fix errors. The legal basis is our legitimate interest in secure and stable operation (Art. 6(1)(f) GDPR).

The logs are deleted automatically according to the fixed retention periods of our hosting provider: access and error logs of the web server after 7 days, access logs of the content delivery network after 30 days at most, and event and system logs of the content delivery network after 180 days. Security logs used to defend against attacks are kept for at least six months and only for as long as is necessary for this purpose. Where log data is contained in the weekly backups, it is deleted after 6 weeks.

Hosting

This website is hosted by Hostinger International Ltd., 61 Lordou Vironos Street, 6023 Larnaca, Cyprus, and delivered via Hostinger’s content delivery network. Hostinger processes the data mentioned above on our behalf under a data processing agreement (Art. 28 GDPR). Hostinger uses sub-processors, including companies based in the USA. Where data is transferred to countries outside the European Economic Area in the process, this is done on the basis of EU standard contractual clauses (Art. 46 GDPR).

Cookies and tracking

This website itself does not set any cookies, does not use any analytics or tracking services and does not load any third-party content such as external fonts, maps or videos. To protect against attacks, the content delivery network of our hosting provider may carry out an automatic browser check if it detects unusual traffic. After a successful check, a cookie used solely for this purpose is stored in your browser. This cookie is strictly necessary and therefore does not require consent (section 165(3) of the Austrian Telecommunications Act 2021, TKG 2021). The legal basis for the related processing is our legitimate interest in the secure operation of the website (Art. 6(1)(f) GDPR).

Contact by email or phone

If you email or call us, we process your name, your email address or phone number and the content of your enquiry in order to respond to it. The legal basis is Art. 6(1)(b) GDPR where your enquiry concerns the conclusion or performance of a contract, and otherwise our legitimate interest in responding to enquiries (Art. 6(1)(f) GDPR). We store this information until your enquiry has been dealt with. To comply with statutory retention obligations (section 212 of the Austrian Commercial Code, UGB; section 132 of the Austrian Federal Fiscal Code, BAO), we keep messages that qualify as business letters for seven years from the end of the relevant calendar year (Art. 6(1)(c) GDPR).

Our email service (Microsoft 365) is operated by Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, D18 P521, Ireland, as a processor (Art. 28 GDPR). In individual cases, for example for support and security purposes, Microsoft may transfer data to Microsoft Corporation in the USA or to other sub-processors outside the European Economic Area. This is based on the European Commission’s adequacy decision on the EU-U.S. Data Privacy Framework, under which Microsoft Corporation is certified, and on EU standard contractual clauses (Articles 45 and 46 GDPR). You can request a copy of the EU standard contractual clauses referred to in this privacy policy from us at office@smp-holding.at; their text is set out in the Annex to Commission Implementing Decision (EU) 2021/914.

Your rights

You have the right of access, rectification, erasure and restriction of processing as well as the right to data portability (Articles 15 to 20 GDPR). To exercise these rights, please contact office@smp-holding.at. You are not obliged by law or contract to provide your data. However, this website cannot be displayed without the technically necessary data, and we cannot reply to you without your contact details. There is no automated decision-making, including profiling.

Right to object

Where we process your data on the basis of our legitimate interest (Art. 6(1)(f) GDPR), you may object to this processing at any time on grounds relating to your particular situation (Art. 21 GDPR).

Right to lodge a complaint

If you consider that the processing of your data infringes data protection law, you may lodge a complaint with a data protection supervisory authority; in Austria, this is the Austrian Data Protection Authority (Österreichische Datenschutzbehörde), Barichgasse 40–42, 1030 Vienna, dsb@dsb.gv.at, www.dsb.gv.at.
